Who can challenge a commercial claim, and how and when?

The Authority acts on its own initiative, or following a complaint. This can happen before, during and after a commercial transaction has taken place.

Traders have the burden of proof to support their claims and to be prepared to provide it to the competent supervisory authorities in a comprehensible manner if the claim is challenged.

The Directive calls on the consumer protection authorities of Member States to assess commercial practices on a case-by-case basis.
